Federal Court Permits Suit Challenging Florida Foreclosure Filing Fees

Fort Myers, FL - Attorney Marcus W. Viles, a consumer advocate at the plaintiffs' law firm of Viles & Beckman, LLC announced that U.S. District Court Judge John E. Steele of the Middle District of Florida issued an order on November 30, 2011 denying in large part the motions of Florida Governor Rick Scott, Florida Attorney General Pam Bondi, and the Florida Department of Revenue, to dismiss a class action filed on behalf of a proposed class of foreclosure litigants over Florida's foreclosure filing fees.

"With the Court's order, Florida foreclosure litigants have overcome significant obstacles in their legal effort to challenge the reprehensible filing fees as unlawful under both the 5th and 14th Amendments to the U.S. Constitution and Article 1, Section 21 of the Florida Constitution," said Viles. "Charging homeowners up to $1900 to file defensive counterclaims, violates citizens' due process and access to the Courts guarantees under the Constitution."

In the Court's Order, Judge Steele ruled "The Court finds that this case is ripe for adjudication and that the plaintiffs allege sufficient injury in the Complaint to satisfy the case or controversy requirement. Plaintiffs have clearly pled that they are defendants in various foreclosure proceedings throughout the State of Florida and are currently being assessed a filing fee pursuant to the challenged statute … Plaintiffs have demonstrated a sufficient injury that is defined, concrete, and mature for purpose's of Article III's case or controversy requirement."
